This is our contract with you. It explains what we do, what you do, and how we handle your data. Please read the sections on privacy, changes to terms, and our liability carefully.

Legal Disclosures

We provide an online platform designed to facilitate comprehensive legal self-help resources, estate document generation, and educational digital content. By utilizing our services, you expressly acknowledge and agree that Wasiyya Legal is not a registered law firm and does not provide formal legal representation, advocacy, or specialized legal advisory services. All interactions on our digital platforms are governed strictly by these terms of service and our corresponding Privacy Policy. We reserve the absolute right to update, modify, or deprecate any portion of our platform or these underlying agreements at our discretion, with notice delivered on our website. Your continued engagement with our platform subsequent to any published updates constitutes direct acceptance of the modified legal terms. To the maximum extent permitted under applicable jurisdictions, our aggregate liability is limited strictly to the service fees paid, preserving your statutory Consumer Law Rights.

1. Engagement and Term

These terms start when you agree and end when the service is finished. We use some third parties (like lawyers and printers) but they are independent of us. We can change these terms but will tell you if it’s a big change.
CONTRACTUAL TERMS

(a) This Agreement commences on the date the Client accepts these Terms and continues until the Services are fully delivered, unless terminated earlier in accordance with its provisions.

(b) The Client engages Wasiyya Legal to perform estate planning and documentation preparation services as detailed in the Service Specification.

(c) Wasiyya Legal may engage qualified third-party contractors, including legal practitioners, specialized consultants, and printing services, to facilitate the delivery of Services.

(d) Such third parties are independent operators and Wasiyya Legal maintains supervisory oversight over deliverables but is not liable for external delays.

(e) These Terms may be amended by Wasiyya Legal from time to time. The Client will be formally notified of any material variations impacting their rights.

(f) Continued instruction of Wasiyya Legal following notification of changes constitutes acceptance of the amended Terms.

Disclaimer: The materials and documentation provided under this Agreement are for educational and estate planning administration purposes only and do not constitute formal courtroom legal representation unless explicitly agreed in a separate Letter of Engagement.

2. Account & 3. Will Creation

PLAIN ENGLISH SUMMARY
You need an account to use Wasiyya. Keep your login safe. If you pay for a Lawyer Review, an independent solicitor checks your will for technical errors, but they aren’t giving you full personal legal advice. You are responsible for the accuracy of what you type in.

2. Account Security & Responsibilities

To access and utilize the Wasiyya platform, you must establish a secure customer account. You represent and warrant that all information provided during registration is entirely accurate, factual, and complete. You are solely responsible for maintaining strict confidentiality of your credential parameters and assume liability for any actions, executions, or modifications generated under your account profile.

3. Will Creation & Independent Review

(a) Automated generation processes are guided strictly by the factual declarations, asset details, and familial designations you manually input.

(b) Any custom technical review executed via our optional ‘Lawyer Review’ is delegated strictly to an independent solicitor.

(c) The scope of such evaluation remains restricted exclusively to a technical checking mechanism for formatting and structural standard compliance.

(d) The reviewing solicitor does not verify, confirm, or audit the physical reality, ownership status, or valuation of your listed assets.

(e) Under no circumstances shall the review constitute bespoke legal, financial, tax planning, or holistic legal representation.

(f) You acknowledge sole liability for the correct validation and spelling of all names, dates of birth, and identity declarations.

(g) The generation of Shariah-compliant allocations relies strictly upon standard standardized parameters and algorithmic logic based on your custom inputs.

(h) Submitting false or misleading operational parameters voids any procedural assurance or correctness checks provided by the platform.

(i) No attorney-client relationship is structured between you and Wasiyya Legal through regular automated portal operations.

(j) Subsequent manual adjustments to the document structure post-review completely nullify the professional technical certificate of review.

(k) Total platform structural liability is strictly bounded and limited directly to the exact fee paid for the corresponding document creation service.

4. Fees & 5. Licence

Plain English Summary

You must pay for services upfront. You get a right to use our platform for yourself, but you can’t copy our code, templates, or logic to build a competing business. Don’t use the platform for anyone else without their consent.

4. Fees & Payment Terms

4.1 All applicable fees for the digital services, templates, or subscription tiers provided by Wasiyya Legal must be settled in full and upfront. Access to our proprietary online builders, dynamic legal engines, and finalized documents is strictly contingent upon successfully cleared payments.

4.2 Non-payment or payment reversals will result in immediate suspension of account privileges, revocation of unfinished templates, and denial of document execution capabilities.

5. Proprietary License

5.1 Wasiyya Legal grants you a personal, non-exclusive, non-transferable, revocable licence to access and make use of the platform and document delivery structures in accordance with these Terms. This licence is issued solely for your individual or private business use.

5.2 You are expressly prohibited from copying, adapting, reverse-engineering, or extracting our core code, specialized structural templates, decision-tree logic, or styling systems to develop, train, or inform any competing commercial offer, software product, or legal drafting system.

5.3 You warrant that you will not use this platform to render documents for third parties for commercial gain or representation without obtaining explicit prior written consent from Wasiyya Legal.
WASIYYA LEGAL TERMS

8. Restricted Use & 9. Your Data

PLAIN ENGLISH SUMMARY
Our Fara’id logic and templates are our intellectual property. You cannot use them for commercial gain. We don’t own your data, but we use it to generate your will and run the service. We never sell your data for advertising.

8. Restricted Commercial & Intellectual Use

All structural logic, algorithmic frameworks, mathematical models governing Fara’id distribution ratios, document layouts, and standard templates developed on this platform are the sole proprietary property of Wasiyya Legal. You are granted a limited, personal, non-transferable, and revocable license to utilize these templates and calculators solely for your own individual planning. Commercial adaptation, systematic extraction (scraping), redistributing, or incorporating our proprietary Fara’id code and generated files into any other legal service or platform for commercial gain is strictly prohibited and constitutes copyright infringement.

9. Your Data, Ownership & Privacy Protections

We do not claim proprietary ownership over the personal assets, family declarations, genealogies, or private records that you upload, input, or save within our system. You retain all underlying rights to your personal information. By providing your data, you grant Wasiyya Legal a restricted, secure license to host, parse, and utilize this information exclusively to compile your legal documents and host your dashboard. We strictly adhere to modern regulatory compliance standards. Under no circumstances will Wasiyya Legal sell, rent, monetize, or disclose your estate data to third-party ad networks, trackers, or commercial brokers.

Liability & Termination

What this means for you

Our liability is limited to the fees you paid. We can suspend your account if there is unauthorized access. You can cancel anytime, and we can end the service with 30 days notice.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Wasiyya Legal and its subsidiaries, affiliates, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the services; (ii) any conduct or content of any third party on the services; or (iii) unauthorized access, use, or alteration of your transmissions or content. In no event shall our aggregate liability for all claims relating to the services exceed the total amount of fees paid by you to us during the twelve-month period preceding the event giving rise to liability.

13. Termination & Suspension

We reserve the right, with or without notice, to temporarily suspend or permanently terminate your account and disable your access to the services if we suspect unauthorized access, fraud, breaches of security protocols, or any violation of these Terms. You are entitled to terminate your account and cancel your subscription at any time via your account settings dashboard. Upon cancellation, your access will continue until the end of your current billing cycle. Either party may terminate this agreement for convenience by providing thirty (30) days prior written notice to the other. Upon termination, all provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Definitions

The following capitalized terms shall have the meanings specified below for all purposes of this Agreement and associated testamentary documents.

Account

The digital interface and personalized profile established by a User on the Wasiyya Legal platform to access, draft, execute, and store Shariah-compliant estate planning documents.

Competing Use

Any direct or indirect utilization of the Wasiyya Legal platform, its code, document logic, proprietary templates, or user flow to build, assess, copy, or distribute a competitive digital inheritance or estate planning software.

Executor

The fiduciary designated by the testator within their Wasiyya, responsible for administering the estate, paying outstanding debts, and distributing assets in strict compliance with the legal provisions and Islamic law.

Wasiyya

An Islamic will or testamentary bequest containing instructions for the post-death distribution of up to one-third of the testator’s estate, intended for individuals or causes not receiving a fixed legal share under Shariah.
